The Senate met at 10 a.m.
(Senator Tomblin, Mr. President, in the Chair.)
Prayer was offered by the Honorable Brooks F. McCabe, Jr., a
senator from the seventeenth district.
Pending the reading of the Journal of Tuesday, March 11, 2003,
On motion of Senator Kessler, the Journal was approved and the
further reading thereof dispensed with.
The Senate proceeded to the third order of business.
Executive Communications
The Clerk then presented a communication from His Excellency,
the Governor, advising that on March 11, 2003, he had approved Enr.
Senate Bill No. 164, Enr. Senate Bill No. 166, Enr. Senate Bill No.
205 and Enr. Senate Bill No. 414.
The Senate proceeded to the fourth order of business.
Senator Rowe, from the Joint Committee on Enrolled Bills,
submitted the following report, which was received:
Your Joint Committee on Enrolled Bills has examined, found
truly enrolled, and on the 12th day of March, 2003, presented to
His Excellency, the Governor, for his action, the following bills, signed by the President of the Senate and the Speaker of the House
of Delegates:
(Com. Sub. for H. B. No. 2357), Authorizing the aeronautics
commissioner to expense funds.
(Com. Sub. for H. B. No. 2529), Relating to the licensure and
regulation of psychophysiological detection of deception examiners.
(H. B. No. 2669), Hazardous waste management.
(Com. Sub. for H. B. No. 2733), Increasing funds in the
special revenue accounts for the criminal investigation division
and the special audits division.
And,
(H. B. No. 3108), Making all business entity filing
requirements consistent with the corporation requirements under the
new corporation laws.

Senator Bailey then moved that the Senate adjourn until
tomorrow, Thursday, March 13, 2003, at 6 p.m.
The question being on the adoption of Senator Bailey's motion,
and on this question, Senator Bailey demanded the yeas and nays.
The roll being taken, the yeas were: Bailey, Boley, Bowman,
Caldwell, Deem, Dempsey, Edgell, Facemyer, Fanning, Helmick,
Jenkins, Kessler, Love, McCabe, Minard, Minear, Prezioso, Ross, Rowe, Sharpe, Smith, Snyder, White and Tomblin (Mr. President)--24.
The nays were: Harrison, Hunter, McKenzie, Oliverio, Plymale
and Sprouse--6.
Absent: Chafin, Guills, Unger and Weeks--4.
So, a majority of those present and voting having voted in the
affirmative, the President declared Senator Bailey's motion had
prevailed.
In accordance with the foregoing motion, the Senate adjourned
until tomorrow, Thursday, March 13, 2003, at 6 p.m.
